Is between you (the “Licensee”), and us (http://Garcya.us) (the “Licensor”). By purchasing or downloading any stock vectors licensed by Garcya Design, you agree to the followings:
Licensor owns all proprietary rights in and to all copyrightable works, generally described as stock vectors, all of which are displayed and viewable at http://Garcya.us (the “Work”), and has the exclusive right to license others to produce, copy, make, or sell the Work.
Licensee can be granted either a Standard license or Extended license. If Licensee does not specify an Extended license, or if an Extended license is not available for the Work requested, the Work will be subject to Standard license terms.
Licensee is granted a non-exclusive, non-transferrable license to use the Work, royalty free, for personal, commercial, and client projects, including advertising, web design, software application, multimedia design, film, video, and computer games. Licensee may not use the Work in projects that it intends to sell or distribute.
You have rights to use or modify any of our vectors :
- in any personal/design/software projects or applications
– in prints for packaging (cd covers, gift wraps, etc.)
– in advertising prints( posters, fliers, etc)
– in websites as part of the design
You do not have rights to use or modify any of our vectors:
- incorporated into merchandise for sale (t-shirts, mugs, posters, etc..) -incorporated into websites or software for resale or distribution
– redistribute/resell/lease/license/sub-license or offer free downloads of our vectors in their present form or in a modified form to any third party
– you are not allowed to use our vectors in electronic bulletin boards/ or other type of websites in downloadable format.
– for any resellable web applications or software programs you should not include our vectors as an additional attachment to boost your software sales or for any other purpose. Providing additional vectors to customers will be considered as a redistribution of our vectors which is not permitted by Garcya Design.
Licensee who has obtained an Extended license has a non-exclusive, non-transferrable rights to use the Work for in the course of its business and to otherwise copy, make and use the Work in its own products that it intends to sell or distribute.
You have rights to use or modify any of our vectors : – in any personal/design/software projects or applications
– in prints for packaging (cd covers, gift wraps, etc.)
– in advertising prints( posters, fliers, etc.)
– in websites as part of the design – incorporated into websites or software for resale or distribution
– incorporated into merchandise for sale (t-shirts, mugs, posters, etc.)
You do not have rights to use or modify any of our vectors:
- redistribute/resell/lease/license/sub-license or offer free downloads of our vectors in their present form or in a modified form to any third party
– you are not allowed to use our vectors in electronic bulletin boards/ or other type of websites in downloadable format.
– for any resellable web applications or software programs you should not include our vectors as an additional attachment to boost your software sales or for any other purpose. Providing additional vectors to customers will be considered as a redistribution of our vectors which is not permitted by Garcya Design.
Licensee may not do anything with the Work that is considered by Garcya Design (acting reasonably) as or under applicable law is considered pornographic, obscene, immoral, infringing, defamatory or libelous in nature, or that would be reasonably likely to bring any person or property reflected in the Work into disrepute. Licensee may not place licensed icons on any website in a complete or archived downloadable format.
Licensee may not convey, sublicense, assign, transfer, pledge, hypothecate, encumber or otherwise dispose of this Agreement without the prior written consent of the Licensor.
Licensee shall fully indemnify, defend, and hold harmless Licensor from and against any and all claims, losses, damages, expenses, and liability.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT PRIOR TO AGREEING TO IT. IN CONSIDERATION OF GARCYA DESIGN AGREEING TO PROVIDE THE WORK, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND GARCYA DESIGN, WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION BETWEEN YOU AND GARCYA DESIGN RELATING TO THE SUBJECT OF THIS AGREEMENT.
